By selecting “I agree to the Terms & Conditions of this Contest”, and in consideration of Despair.com evaluating your suggested Demotivator Caption (hereinafter the “Caption”) for possible use in Demotivator products, you agree to the following terms and conditions:

If your Saying is selected for use by Despair.com, you acknowledge that you assign the entire right, title, and interest in and copyright to your Saying to Despair, Inc. (hereinafter referred to as “Despair.com”) for its sole and exclusive use in connection with Demotivators in all of their current and future product forms- including but not limited to- posters, notecards, drinkware, laptop skins, and so forth.

If your Saying is selected, you further authorize Despair.com to make any modifications it deems necessary or appropriate- including word changes, deletions or additions.

You acknowledge the Saying you are assigning to Despair.com is your own original work, it has not been previously published, and it doesn’t not contain any copyrighted material, trademarks, logos or other intellectual property belonging to any third party. Further, you agree to indemnify Despair, Inc. against any claims by third parties arising from your submission.

If your Saying is selected, you will be awarded $250 in cash as payment, effective upon publication of your Saying as a Demotivator. You alone will be responsible for the payment of any tax liabilities related to your receipt of payment from Despair.com.

In the event that no entry to the contest is determined suitable for use as a Demotivator Saying, the competition will be considered void and no prize will be awarded. So please- write something funny.
